FAQ

Frequently Asked Legal Questions

Do I need a lawyer to register a company in Tanzania?

The law does not always require one, but an advocate ensures your Memorandum and Articles, shareholding structure and filings are correct and aligned with your business plans, which avoids costly amendments later.

Can a foreigner own land in Tanzania?

Non-citizens generally cannot own land outright. Investors usually obtain a derivative right for an approved investment project through the Tanzania Investment Centre.

How long do I have to challenge an unfair termination?

Termination disputes go to the Commission for Mediation and Arbitration within a short statutory period, so you should seek advice immediately after termination.

Are contracts in Tanzania valid if they are only oral?

Many contracts can be oral, but some, such as land transactions, must be in writing and registered. A written agreement is always the safest way to prove terms.

Which dispute resolution method is best for business?

It depends on the value, urgency and relationship. Arbitration and mediation are often faster and more confidential, while court litigation suits claims that need binding public precedent or interim orders.
